License agreement

This End User License Agreement accompanies the 'Social Downloader for Facebook, Instagram and Twitter' (from now on called 'Social Downloader') product and related explanatory materials, including any upgrades, modified versions or updates (from now on called 'Software') licensed to you by Sakysoft s.r.l. Please read this Agreement carefully. At the end, you will be asked to accept this agreement and continue to install or, if you do not wish to accept this Agreement, to decline this agreement, in which case you will not be able to use the Software. Upon your acceptance of this Agreement, we grant you a nonexclusive license to use the Software, provided that you agree to the following:

1. Use of the Software
You may install the Software on a hard disk or other storage device and make backup copies of the Software. Social Downloader can be re-distributed on internet, CD-ROM or anything, freely as long as NO FEE is charged and all the files remain INTACT AND UNMODIFIED. If you download the Software from the Internet or similar on-line source, you must include this copyright notice for the Software with any on-line distribution and on any media you distribute that includes the Software. 2. Advertisers
The ads appearing on our sites and within Social Downloader application are delivered by us or by our advertising partners. These ads may contain cookies. Social Downloader comes with web based ads. In the course of serving advertisements to those sites or Social Downloader application, we or advertising partners may place or recognize a unique 'cookie' on your browser. We use cookies to deliver content specific to your interests, among other purposes. The advertising company also may read or set cookies, track which ads you have viewed, or collect other information about you. The privacy practices of the advertising company, advertisers, and other companies are not covered by this privacy policy. Please contact those companies directly for more information about their privacy practices. You may set your browser to notify you when you receive a cookie.

3. Information Automatically Logged
In our sites we use your IP address and product usage data to help diagnose problems with our server, to administer our Web sites, and improve how our products are used by you. Your IP address is also used to gather broad demographic information, and other end-user usage data to help improve our product over time.

4. Content
Sakysoft s.r.l. may provide links to Internet sites or resources not owned or controlled by Sakysoft s.r.l. Because Sakysoft s.r.l. has no control over such sites and resources, you acknowledge and agree that Sakysoft s.r.l. is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Sakysoft s.r.l. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by the use of or reliance on any such content, goods, or services available on or through any such site or resource.

5. Data protection
Social Downloader never holds any of your personal data. Personal information you provide is not stored in any external internet server, neither is any identifiable information connected to your social networks download and backup activities, as all your and your friends' data and contents are transferred directly to your computer. Your username and password are never seen, stored or used by Social Downloader for any different purpose. All the contents downloaded by Social Downloader remain of sole property of the owner. Social Downloader users must comply with owners' rules and restrictions and remain the solely responsible of any kind of misuse or data owner's rules infringements. Users who don't abide by the data owners' rules do it at their own risk. Social Downloader is not liable for those illicit activities in any way and at any time.

6. Copyright and Trademark Rights
The Software is owned by Sakysoft s.r.l., and its structure, organization and code are the valuable trade secrets of Sakysoft s.r.l. The Software is also protected by Italian and European Copyright Law and International Treaty provisions. You may use trademarks only insofar as required to comply with Section 1 of this Agreement and to identify printed output produced by the Software, in accordance with accepted trademark practice, including identification of trademark owner's name. Such use of any trademark does not give you any rights of ownership in that trademark. Except as stated above, this Agreement does not grant you any intellectual property rights in the Software.

7. Restrictions
You agree not to modify, adapt, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software. You are not allowed to sell, re-sell, rent or lease Social Downloader, any portions of it or its license or any portions of a license without written permission from the Author. You are not allowed to remove any product identification, copyright, proprietary notices or labels from Social Downloader. Social Downloader users must be at least 18 years old at time of use.

8. Termination
Without prejudice to any other rights, the Author of this Software may terminate this End-User License Agreement if you fail to comply with the terms and conditions of this End-User License Agreement. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

9. No Warranty
The Software is being delivered to you AS IT IS and the author and his team make no warranty as to its use or performance. SAKYSOFT S.R.L. DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE OR DOCUMENTATION. SAKYSOFT S.R.L. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SAKYSOFT S.R.L. BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS OR FOR ANY CLAIM BY ANY THIRD PARTY. The entire risk arising out of use or performance of the SOFTWARE remains with you. Some states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or the exclusion of implied warranties or limitations on how long an implied warranty may last. IN SUCH EVENT YOU MUST NOT INSTALL THE SOFTWARE PRODUCT. Sakysoft s.r.l. is under no obligation to maintain, support or update Social2DesktopSocial Downloader in any way, or to provide updates or error corrections.

10. Governing Law and General Provisions
This agreement shall be governed by the International Copyright laws, the Copyright laws of Italy and the Copyright laws of European Union. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any export laws, restrictions or regulations. This Agreement shall automatically terminate upon failure by you to comply with its terms. This Agreement may only be modified in writing signed by Sakysoft s.r.l.

Social Downloader is not affiliated or endorsed by Facebook, Twitter, Instagram in any way.

Social Downloader are for entertainment purposes only.

Any third party names, trademarks or images appearing in the Social Downloader are the property of their respective owners.
